CUSTOMS DIVISION

INTRODUCTION

The Customs Division in Headquarters of The Royal Malaysian Customs Department is headed by a Director of Customs (Grade VU7) who is assisted by two (2) Deputy Directors of Customs (Grade W54). This Division consists of two (2) branches and 11 units . The two (2) branches and the respective units are as follows:

1. Trade Facilitation And Industry Branch:

  • Warehousing Management & Control Unit
  • Facilities & Incentive Management & Control Unit
  • Licensing Database Management Unit
  • Free Industrial and Commercial Zone Management & Control Unit
  • Licensed Manufacturing Warehouse Management & Control Unit

2. Import/Export and Border Control Branch:

  • Import Management & Enforcement Unit
  • Export Management & Enforcement Unit
  • Duty Free Island/Duty Free Shop Management & Enforcement  Unit
  • Travellers/Border Management & Enforcement Unit
  • Taxation Policy & Analysis Unit
  • Inter-Agencies Commitment Unit

Objective Of Division

  • To implement policies related to industries, import, export and border control established by the department and the government.
  • To establish procedure related to industries, import, export and border control which is inline with the stipulated policies of the department and the government.
  • To study and review policy and/or procedure concerned for enhancement and simplification to ensure predictability in its implementation.
  • To provide cooperation and facilitation to other government agencies.
  • To implement international commitment and cooperation with 'World Customs Organization (WCO), Association of Southeast Asian Nations (ASEAN), World Trade Organization (WTO) and  Asia-Pacific Economic Cooperation (APEC) as well as Free Trade Agreements with other countries.
  • To provide guidelines to customs officers at the frontline to ensure efficient implementation of customs policy and procedure.

ROLE OF CUSTOMS DIVISION

1.         TRADE FACILITATION AND INDUSTRY BRANCH

1.1        Warehousing Management And Control Unit

i.     Formulate and enforce legislations, policies and procedures in line with international best practices.

ii.   Evaluate applications for Public Licensed Warehouse, Private Licensed Warehouse and Inland Clearance Depot.

iii. Applications for remission of duty/tax (Section 18, Customs Act 1967 and Section 33 Sales Tax Act 1972)

iv.  Ensure compliance by the warehouse operators.

v.  Consultation and advice to business community/investors.

1.2     Facilities and Incentives Management And Control Unit

i.   Evaluation of procedures, policy and legislation related to duty/tax exemptions granted by Minister of Finance

ii.   Ensure compliance to the conditions as stipulated in the Treasury Exemptions.

iii.   Evaluate and recommend applications for Authorised Economic Operator Scheme(AEO).

iv.   Evaluate and recommend applications for duty/tax remissions by Minister of Finance (Section 14A Customs Act 1967).

v.   Conduct awareness programs related to current policy to ensure compliance by business community/manufacturers

vi.   Consultation and advice to business community/investors

1.3        Licensing Data Base Management Unit

i. Plan and collate data related to Customs matters

ii.   Develop risk indicators on Customs activities

iii. Analyse data to determine potential threats, weaknesses  and current trends of  Customs  Activities

iv.   Provide data information for decision support.

v.   Issue Risk Profiles and Alert Notice to all States/Stations.

vi.   Publish bulletins and reports on Customs activities.

1.4    Free Industrial and Commercial Zones Management And Control Unit

i.  Formulate and enforce legislations, policies and procedures.

ii.Monitor and enhance regulations/procedures to ensure compliance by business community/ manufacturers.

iii. Analyse and process applications for CEPT rates, value added activities and duty exemptions.

iv.  Consultation and advice to business community/manufacturers/ investors.

1.5       Licensed Manufacturing Warehouse Management And Control Unit

i.   Formulate and enforce legislations, policies and procedures.

ii. Monitor and enhance regulations/procedures to ensure  compliance by  manufacturers.

iii. Analyse and process applications for CEPT rates, value  added activities  and sale of 'replacement parts' as spares

iv  Consultation and advice to business community/manufacturers/ investors.

2.   IMPORT/EXPORT AND BORDER CONTROL BRANCH

2.1    Import Management and Enforcement Unit

i.      Formulate and enforce legislations, policies and procedures on import/transshipment/forwarding and shipping agents to ensure compliance with  World Customs Organisation SAFE Framework of Standard (FoS),  Revised Kyoto Convention (RKC) and other contracted agreements

ii.      Enforce the implementation of the Strategic Trade Act 2010,  IPR Act and other relevant legislations.

iii.      Evaluate and enhance system and procedures to  facilitate import and transsshipment.

iv.      Process applications for extension period of temporary Import and ATA Carnet.

v.   Process applications for General Bond.

vi.   Process application for remission of duty/tax.

vii.      Consultation and advice to business  community/importers

2.2   Export Management and Enforcement Unit

i.    Formulate and enforce policies, procedures and legislations on import/transshipment/Forwarding and Shipping Agents to ensure compliance with  World Customs Organization SAFE Framework of Standard (FoS),  Revised Kyoto Convention (RKC) and other contracted agreements.

ii.   Enforce the implementation of the Strategic Trade Act  2010,  IPR Act and other relevant legislations.

iii.  Evaluate and enhance system and procedures to facilitate export and transshipment.

2.3 Duty Free Island(DFI)/Duty Free Shops(DFS) Management and Enforcement Unit

i.        Formulate and enforce legislations, policies and procedure.

ii.      Evaluate and enhance system and procedures to ensure compliance by licences

iii.    Process applications for import licences of intoxicating liquor, tobacco and denatured spirit and ensure compliance by licences.

iv.     Process applications for Duty Free Shops Licence.

v.       Process applications for Restriction of Movement of goods.

vi. Conduct consultation and advice to business  community/investors

2.4    Travellers / Border Management And Enforcement Unit

i.        Formulate and enforce legislations, policies and procedures.

ii.      Evaluate and enhance system and procedures to facilitate movement of bona fide travellers and trade in goods.

iii.    Facilitate the movement of goods in transit.

iv.     Conduct feasibility studies on new border stations and legal landing places.

v.       Cooperation with other government agencies on matters related to  national border security controls.

vi.     Enforce the implementation of the [Anti Money Laundering and Financing Terrorism Act 2001]

vii  Consultation and advice to travellers and other Government Agencies.

2.5    Taxation Policy and Analysis Unit

i.       Study and analyse customs issues, effectiveness of taxation policy and the current legislation.

ii.    Propose new taxation policies and legislation.

iii.      Conduct feasibility studies to enhance delivery system of customs services.

2.6   Inter Agencies Commitment Unit

i.        Conduct consultation and advice to investors and MIDA on legislations, policies and procedures related to customs matters.

ii.      Enhance cooperation with MIDA, agencies under MITI and other Government Agencies in relation to customs legislations and procedures.

Customs Activity

  1. To implement customs clearance for import via air mode( 180 mins.), sea mode (130 mins.) and land mode (60 mins).
  2. To implement customs clearance for export via airmode (30 mins.), sea mode (180 mins.) and land mode (60 mins).
  3. To approve customs clearance for goods in transit via air mode (60 mins.), sea mode (130 mins.) and land mode (30 mins.).
  4. To implement travellers' clearance within 30 minutes.
  5. To approve application for extension of Temporary Import for importation which is more than one year from the date of import within seven (7) days.
  6. To approve application for the Restricted Movement of goods within three (3) days.
  7. To approve the application for Private Bonded Warehouse Licence and Public Agent  Warehouse Licence within seven (7) days from the date the completed report is received from the State Customs Director
  8. To process and forward to the Ministry of Finance the applications for Public Bonded Warehouse Licence, Inland Clearance Depot Licence and Duty Free Shop Licence  that have been received from the State Customs Director  within seven (7) days.
  9. To approve application for duty exemptions of finished products for local sales, application for transfer/export of raw materials, components, machines and spare parts and application to operate a  International Procurement Centre (IPC) within seven (7) days.
